In late 2017, Kmart agreed to negotiate a new enterprise agreement for workers. RAFFWU represents its members in those negotiations. We have met with Kmart and we are pressing all our claims on behalf of our members.
Kmart workers have been without a new agreement for 3 years. The old agreement has been kept in place because Kmart is saving tens of millions of dollars every year by not paying minimum Award penalty rates. RAFFWU members exposed this dodgy behaviour in 2015 & 2016 at Coles and we know Kmart is benefiting from the same tricks.
Kmart helps SDA recruit members and SDA helps Kmart keep in place these old deals which cut penalty rates and other conditions.
It's time Kmart workers had a union at the negotiation table that cared about them and not an outdated political agenda.
Minimum Award penalty & other rates are:
- 25% for casual staff (not 20%)
- 95% penalty rate on Sunday (not 50%)
- 25% penalty rate on Saturday (35% for casual staff)
- 25% penalty rate on weeknights between 6pm and 11pm
- overtime pay on weeknights/mornings between 11pm and 7am
- 60% for 17 year old staff (not 57.5%)
- 70% for 18 year old staff (not 67.5%)
Our campaigns have meant Kmart has agreed it must substantially improve many wage rates - but Kmart has refused to backpay the thousands of workers who earn less than the minimum Award. If you are casual, 17 or 18, work weeknights or weekends, you are probably losing out.
We represent members who appoint us as their bargaining representative in bargaining. We will provide your appointment letter/email to Kmart and they must then negotiate with us as your bargaining representative. Kmart has agreed that we will be involved in bargaining.
We have no time to lose. We intend to restore and improve upon every Award right. This means being active in store, with workmates and in negotiations.
Members unanimously endorsed our claims for bargaining.
If you want your union to negotiate with Kmart as your bargaining representative for these claims, you need to join RAFFWU, appoint us as your bargaining representative, and tell your colleagues! You can join quickly and easily online at www.raffwu.org.au/membership or download and return our application form.
